The SoulWave App, its website, and other related services are developed and provided by HONG KONG KEHEN TECHNOLOGY LIMITED (hereinafter referred to as "we," "our services," or the "application"). These Terms of Service constitute an agreement between you and us. If you do not accept or agree to these terms, please do not access or use this website and/or the application. Your use of this service constitutes "express consent" as defined by applicable law.
1. Qualified
If you lack full civil capacity due to age, mental condition, or other reasons, you may not use our services.
You must be 18 years of age or older, or the legal age of majority in your jurisdiction, whichever is higher, to use this service.
You are responsible for ensuring that your use of the Service complies with applicable laws and regulations. You agree to fully comply with all applicable laws and regulations when using the Service. If any applicable law prohibits your use of or plans to use this Service, you may not use it.
2. Privacy
We collect, use, store, and share your personal information in accordance with these terms and our privacy policy (please see our privacy policy for details).
3. Child safety standards and policies
A. Zero tolerance for child sexual abuse and exploitation (CSAE)
We have a zero-tolerance policy for any form of child sexual abuse or sexual exploitation (CSAE). Any user who does not comply with SoulWave's policy of protecting minors (under 18 years of age), as described below, will be removed from SoulWave and may face legal consequences.
B. Prohibition of Sexual Abuse and Exploitation of Children (CSAE)
Prohibited activities
The following content is strictly prohibited on this platform:
Content creation or sharing:
Uploading, sharing, or distributing any images, videos, texts, or other media that depict child sexual abuse or exploitation.
Create or participate in groups, chat rooms, or communities that promote or glorify such behavior.
Sorting and enticing:
Attempting to establish inappropriate relationships with minors for exploitative or abusive purposes. Manipulating or coercing minors to share explicit content.
Unauthorized use of the platform:
Using the platform to identify, contact, or communicate with minors for abusive or exploitative purposes.
Facilitating or assisting trafficking or other criminal activities involving minors.
Prevention and enforcement
To ensure compliance with this policy, we have implemented the following measures:
Content Monitoring: Automated systems and human moderators proactively monitor illegal or inappropriate content. Suspicious content may be flagged, reviewed, and reported for investigation. User Reporting Tool: Users can report suspicious violations through the in-app reporting tool or our support channels. Cooperation with Law Enforcement: We cooperate with law enforcement authorities to investigate and resolve violations, including sharing information as required by law. Account Penalties: Accounts involved in prohibited activities will be permanently banned, and related data may be retained for use in legal proceedings.
C. Your role in child protection
We encourage all users to become vigilant community members by:
Report any suspicious activity or content immediately. Avoid sharing minors' personal information to protect their privacy and safety. Learn about and raise awareness of online child safety.
Any violation of this policy will be dealt with in the most serious manner. We are committed to maintaining a safe and abusive environment for all users.
4. Content and Behavioral Rules
"Content" means any material that you generate, upload, copy, publish, or distribute while using the Service, including but not limited to account avatars, names, user profiles, registration information, identification documents, or any text, audio, images, video, graphics, or other forms of messages and links sent, received, or automatically replied to, as well as other content generated as a result of your use of your account or the Service.
You acknowledge and agree that you must not do this and warrant that your content and actions will not do so:
Your profile contains offensive or pornographic material.
Contains sexual innuendo or sexual content (e.g., allusions to casual sex, prostitution, or descriptions of genitalia).
Involves the privacy, personal information, or data of others (e.g., detailed addresses or job descriptions).
Insulting, defaming, or otherwise infringing upon the legitimate rights and interests of others
Infringement of another person's reputation, image, intellectual property rights, trade secrets, or other legitimate rights
Spreading obscene, pornographic, gambling-related, violent, murderous, terrorist, or criminal inflammatory content.
Inciting racial hatred or discrimination, or undermining racial unity
Inciting illegal activities
Organizing rallies, associations, demonstrations, or gatherings to disrupt public order
Spreading rumors, disrupting public order, or endangering social stability
Contains any other information prohibited by laws or administrative regulations.
If you violate these terms or any applicable laws or regulations, we reserve the right to restrict, suspend or terminate your account at our sole discretion, and to decide whether to reinstate your access.
We have the right (but not the obligation) to handle illegal or prohibited content or behavior in accordance with these terms. If other users infringe upon your legal rights, you can file a complaint with us, and we will handle it according to law. If your content violates the law or infringes upon the rights of others, SoulWave reserves the right to delete, block, or disable access to such content.
Any content you share through the service does not represent our views or policies, and we assume no responsibility for such content.
You are solely responsible for your interactions with other users of the service. We do not conduct criminal background checks or other investigations on users, but reserve the right to do so at any time. We make no representations or warranties regarding the conduct, information, or statements of users. You agree to take reasonable precautions when interacting with other users. We are not responsible for mediating disputes between users.
5. Rights to use your content
We do not claim ownership of your content. However, you grant us a perpetual, worldwide, royalty-free, non-exclusive license to use, distribute, copy, modify, translate, adapt, publicly perform, and publicly display your content to provide services and for any purpose permitted by our Privacy Policy, and to publish, display, distribute, and store your content as needed. You also grant other users the right to access your content through the Service.
You understand that the technical processing and transmission of data related to your content may involve: (i) transmission across various networks; and (ii) modification to meet the technical requirements of servers, networks, or devices.
6. Copyright
You must ensure that you have or are legally authorized to use any content you upload or post, and that such content does not infringe on the legal rights of any third party (including but not limited to portrait rights and reputation rights).
We reserve the right to remove any allegedly infringing content after notifying the rights holder or relevant party. You are fully liable for all legal claims arising from the infringement. If your infringement causes any loss (including but not limited to financial or reputational damage) to us or our affiliates, you shall fully indemnify us and our affiliates.
You may voluntarily publish your fully copyrighted works on other platforms, but without our prior written consent, you may not directly or indirectly use or authorize any third party to use any content in the application in any form.
7. Fees
We may offer paid services, and you must comply with the relevant agreements. We may adjust or modify the pricing and payment methods for paid services as needed, and may begin charging for previously free services. Any changes will be announced or posted on the relevant pages. If you do not agree to such adjustments, you should stop using the service.
Once the account top-up is complete, the corresponding amount will be credited to your account. We do not offer refunds or cash exchanges.
If you request account deletion, we will not issue any refunds. Please consider carefully before making such a request.
8. Disclaimer and Limitation of Liability
This application is provided "as is". We, our affiliates, and our respective officers, directors, employees, agents, partners and licensors make no warranties or conditions of any kind, whether express or implied.
We make no warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, integration, interoperability, or quiet enjoyment.
We make no representations regarding the accuracy, completeness, timeliness, or non-infringement of any information or other content accessed through this service. We do not warrant that the service will be uninterrupted or error-free, that defects will be corrected, or that the service or the servers providing the service are free of viruses or other harmful components. Some jurisdictions do not allow the exclusion of implied warranties, therefore the above disclaimer may not apply to you.
9. Change
We reserve the right to update or modify these Terms of Service at any time. We will notify you of any updates via in-app notifications, pop-ups, email/SMS, or in-app announcements. If you continue to use the Service after the updated policy takes effect, you will be deemed to have read, understood, and agreed to the updated policy and be bound by it.
